When I was first checking in the prosecutor asked me if I
wanted to keep the ticket off my record.(via deferred
adjudication) I would still have to pay the full fine
plus court fees.
I told her that I was there to do just that, keep it off my
record. However, I wasn't there to plea for deferred
adjudication. She couldn't believe that I wanted to fight it
out in court. I did make her an offer. I told her if she's
willing to drop it to a non-moving violation that I would
consider that. She said "no way" and went on to inform me
that the judge would give me the maximum if found guilty.
I then told her that I didn't have anything to worry about. I
have to admit that she does her job well. Everyone at court
that day took the plea bargain.
When everyone cleared out and I was the "last person
standing", I noticed on her table that she only had one
piece of paper sitting there.
It was my docket sheet. That's all! I knew I had her now.
But even with that knowledge I was very nervous. After all,
this was the first time I fought anything. I followed your
instructions and read word for word from the book.
I gave them the pertinent case laws that you provided and
then let her do her thing.
When she was finished all I had to ask the officer is if he
had the proper logs showing that he calibrated the radar. I
was expecting objections, instead I got a motion to dismiss
by the state. Imagine my surprise! I could hardly contain
myself! I do want you to know, however, that I was ready to
go the distance. I will tell you this also, I will never be
this intimidated again.
